Terms and Conditions
1.1 These terms and conditions apply to all goods supplied by Autoplus Cars Spare Parts Trading L.L.C, whose registered office is at Sheikh Zayed Road Saeed Tower 2, 6th Floor, Office Number 603. Autoplus Cars Spare Parts Trading is registered in Dubai Economic Department Under License Number 660310 (the "Supplier", or "we", or "our") to the customer ("you", or "your") and constitute the entire and only agreement between us in relation thereto. Under the present Contract the Supplier is obliged to sell auto parts, accessories and technical liquids (hereinafter referred to as The Goods) to the Buyer in accordance with the product description, assortment, price and quantity against the agreement by the Parties in the Invoice.
1.2 All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order. The delivery is maintained under the Invoice and Packing List from the Supplier to the Buyer which are given by email to the Buyer or his representative. The Invoice should contain brand names, part numbers, and descriptions, countries of origin, quantities and prices of Goods. The Packing List should contain part numbers, descriptions, quantities, case numbers, volumes and weights of Goods
1.3 We will send you an order acknowledgement (via email) shortly after you place your order, notifying you that we have received your order. This acknowledgement is not notification that we have accepted your order.
1.4 If we accept your order, we will notify you by email when we have dispatched the goods. If we cannot accept your order (for example (but without limitation) because the goods are found to be unavailable) we will notify you by telephone or email.
1.5 In the event that, after we accept your order, we discover that the goods ordered are unavailable or that there was a pricing error on our website in respect of the goods ordered, we reserve the right not to supply the goods ordered and to offer you a refund of the same amount.
1.6 The contract is subject to your right of cancellation. (see condition 4.1)
1.7 We have the right to terminate the contract if the price of the goods is not received from you in cleared funds
1.8 The Supplier may change these terms of sale without notice to you in relation to future sales.
1.9 In the event of a part being unavailable from the manufacturer advertised and an equal or better quality part is available from an alternative manufacturer, the alternative will be supplied at the same price. If no suitable alternative is available a full refund will be issued.
2. Description and Price of Goods
2.1 The description and price of the goods you order will be as shown on our website at the time you place your order. All prices shown does not include any shipping, customs or labor charges which Autoplus Spare Parts reserves the right to add based on the INCOTERMS of shipping. We usually provide all our goods on Ex-works bases unless specified any other term.
2.2 On occasion, the prices payable of goods advertised on our web site may differ from those prices offered at our trade counters, and we are under no obligation to honor any website price if there is such a difference.
2.3 Occasionally an error may occur with our website and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.
2.4 Price Matching with other competitors at the time of confirmed purchase from us:
2.4a The competitor's item must be identical (colour, size etc).
2.4b The competitor's item must be in stock at the time of match.
2.4c The competitor's price must include delivery.
2.4d The competitors price must be publically advertised online and cannot include any membership/personal discounts.
2.4e We cannot match bulk promotional offers such as buy one get one free.
2.4f The competitor must be based in the UAE while having a physical location and sell direct to customers (no auction or marketplace retailers).
2.4g No other promotional offers or vouchers can be used on top of a price match.
2.4h We will only match a price at the time of purchase.
2.4i We will match in store if our online price is lower than our store price.
2.4j We will not match against clearance, closing down sales or specialist retailers such as market stalls.
3. Delivery and Collections
Delivery & Service Charges:
3.1 We aim to dispatch your order within 48 hours of receiving payment (Saturday to Thursday) RETAIL only. The majority of the time your order will be dispatched within 24 hours if completed and paid for before midday (Saturday to Thursday). Orders placed over a weekend or national holiday period will be dispatched within 48 hours of the following working week day. Orders will be sent either by Emirates Post or Local Courier Services depending upon the feasible options. All delivery charges are separate and Charges through Emirates Post can be calculated through our Rate Calculators available. For wholesale orders, please contact our sales team to check for the cargo charges.
3.2 Payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order. Payment shall be due before the delivery date in full and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.
3.3 There will be no delivery until completed & cleared funds are received
3.4 The goods you order will be delivered to the delivery address you give when you place your order. Any change of delivery address after the goods have been dispatched will be subject to a further delivery charge based on management decision.
3.5 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you of any delay as soon as possible and will give you the option of cancelling your order at this point.
3.6 Upon receipt of delivery, you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.
3.7 Same Day Delivery option is only available to certain areas within Dubai. We will attempt to deliver orders on the same day as the order is placed based on the following criteria:
3.7a The order is placed before 12pm, Saturday to Thursday (Excluding Bank & Public Holidays).
3.7b The item(s) are in stock at our Autoplus Spare Parts L.L.C Warehouse on the day the order is received and that full payment of the whole order has cleared.
3.7c A telephone number has been sent with the order and we have managed to speak to the customer to arrange a convenient delivery time. If we are unable to speak directly to the customer before dispatch we will not send the goods and the order will be fully refunded and cancelled.
3.7d Autoplus Spare Parts Trading L.L.C accept no responsibility for unfulfilled same day delivery orders and accept no liability for any loss incurred if same day delivery fails for any reason.
3.7e The customer must be present to sign for the goods when delivery is made. No goods will be delivered if a signature cannot be obtained. In this instance the postal charges for the delivery will not be refunded, only the value of the goods will be refunded. Any redelivery will incur a further Courier or Postal charge. Any delay experienced by the delivery driver in obtaining a signature will result in the goods not being delivered and Courier or Postal charges not being refunded.
3.7f Where an order is taken for a post code that is not within the same day service criteria the order will be cancelled and a notification supplied to confirm that a full refund will be made to the payment card used at order placement.
3.7g Operation of the same day service and postal codes for same day delivery may be subject to change at Autoplus Cars Spare Parts Trading L.L.C discretion. This service can be withdrawn at any point and orders rejected at the company’s discretion.
3.8 The Same Day delivery option is only available to orders placed through the website. Orders placed in store or over the phone are not eligible for Same Day delivery.
4. Cancellation & Returns
4.1 You have the right to cancel the contract at any time up to 7 days after you receive the goods.
4.2 To exercise your right of cancellation, you must give written notice to the supplier within 7 days on delivery, giving details of the goods ordered and their delivery. Notification by phone is not sufficient.
4.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the supplier at your own cost. The goods must be returned to the address shown within the Returns section of the Supplier's website. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. Only goods returned in a re-saleable condition will be accepted for credit and all postal or courier charges involved are non-refundable.
4.4 Faulty goods should be returned in their original packaging, with adequate protection to ensure that the goods and packaging reach us in good condition. Failure to package an item properly will result in us refusing to refund the item regardless as to whether it was faulty or not, as we cannot return damaged faulty items to our suppliers. Any goods found to be faulty will be replaced or refunded, depending on availability of a replacement.
4.5 Due to the nature of certain products available on our website, such as (but not restricted to) car parts, we cannot guarantee any part fitting a vehicle unless you have supplied the full UK registration of the specific vehicle BEFORE you purchase AND we have then confirmed to you, via email, that the part is correct for that vehicle. This process should ensure you receive the correct part .If this process has been followed we will cover any reasonable costs involved in returning any wrong item supplied. If this procedure has not been followed all courier or Postal costs involved in dispatch and return will be non-refundable.
5. Warranty & Liability
5.1 All of our products are covered by a manufacturer’s warranty covering both faulty materials and faulty workmanship, it does not cover general wear and tear or damage. This excludes products or parts of products that are consumables or that wear down.
5.2 Most faulty products will need to be examined before we replace. Please note that we cannot be held responsible for lost returns so please ensure you return them via an appropriate courier or insured method as we do not accept any liability until received by us.
5.3 Faulty goods should be returned in their original packaging, with adequate protection to ensure that the goods and packaging reach us in good condition. Failure to package an item properly will result in us refusing to refund the item regardless as to whether it was faulty or not, as we cannot return damaged faulty items to our suppliers. Any goods found to be faulty will be replaced or refunded, depending on availability of a replacement.
5.4 We shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Our liability to you shall not in any event include losses related to any business of yours, such as loss of profits or business interruption, neither will we be responsible to you for any other loss which is not a foreseeable consequence of us being in breach of these Terms and Conditions or our legal duties.
5.5 This does not affect your statutory rights if you are a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
5.6 Goods are intended for use in the UK only and we cannot confirm that the goods comply with any laws, regulations or other standards applicable outside the UK. All goods are sold in accordance with the manufacturer's specifications and are subject to any qualifications, representations or instructions contained in the documentation associated with the goods.
5.7 Where you place an order for age-restricted goods such as solvents and knives, you confirm that you are over the age of 18 and that delivery will be accepted by a person over the age of 18. We reserve the right to cancel your order if we reasonably believe you are not legally entitled to order certain goods.
5.8 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
5.9 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforce ability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
